. john kerry joked today that he had big heels to fill as the new secretary of state. president obama's second major nominee to face a confirmation hearing was another national security pick, the former senator chuck hagel. his confirmation hearings for defense secretary were not a breeze. the vote on his nomination has not yet happened. republicans in the senate are now hinting that they might even filibuster chuck hagel's nomination for defense, which of course sounds normal, because, you know, it seems like republicans filibuster anything now. but in fact that would not be normal that would be unprecedented if they do it. the reason republicans are even considering doing this unprecedented thing is because they cannot block chuck hagel's nomination by normal means. even though the republicans have persuaded lots of the senators on their own side to oppose his nomination, they are a minority. and they have not persuaded any democrats to oppose him at all, at least none that have come out so far and said they'll vote no. now, there was that strange effort which seems to have been a r
of this week, president obama's nominee to head the cia, john brennan, will face the senate intelligence committee for his confirmation hearing as the director of central intelligence. one of the very first thing president obama did you might remember when he first became president at the start of his first term in 2009 was that he dropped the bush administration's torture policy. remember, he did that right away. he issued an executive order two davis taking office to doubly, triply extra ban torture in the united states. at the start of that first term, newly elected president obama also wanted to nominate john brennan to be the head of the cia. but he didn't end up putting him forward. john brennan ended up taking his name out of contention for that nomination because of opposition to him being chosen. and the opposition centered on the fact that john brennan had been deputy executive director of the cia during the bush days. during the bad old torturing prisoners days of the george w. bush administration. so you're going to have a brand-new president who bans torture, but then you're

of this could come to a head on thursday for john brennan. eight democratic and three republican senators have written to president obama asking for the legal opinions authorizing the killing of americans. joining me now, national investigative correspondent michael isacoff. i saw your report and the reaction to the report. is it really surprising at this point? >> well, i think it's not that surprising, mainly because the administration has been so resistant to releasing any of the memos that explain its legal reasoning behind these drone strikes and in particular the drone strikes targeting american citizens. members of congress have asked to see copies. "the new york times" went to court and sued under the freedom of information act to obtain copies. and the administration has completely shut those requests down saying these memos are classified. if they exist and they're not going to discuss or release anything. so that has sort of built pressure up for the administration to show its cards. these are very consequential policies. we are here talking about american citizens who have constitu

. ♪ >>> welcome back. president obama proposing his plan to head off looming across-the-board spending cuts. john harwooded a the white house right now with the details. john? >> reporter: it wasn't a specific plan but a request for congress to come up with a plan, a short-term plan to put off the across-the-board indiscriminate budget cuts we call the sequester which is established under law. it was put off for two months in january to give the congress time to come up with a budget. they haven't done so yet. both parties in both chambers are working on that, and president obama said if they can't come up with a comprehensive long-term plan over the next several weeks before the sequester takes effect on march 1st they should at least get something smaller. here's the president at the white house today. >> congress is already working towards a budget that would permanently replace the sequester. at the very least we should give them the chance to come up with this budget instead of making indiscriminate cuts now that will cost us jobs and significantly slow down our recovery. >> now, of course,

that confirmation hearing? because we know chuck hagel had a difficult time, john kerry's was fairly straightforward. does this mean that john brennan may have quite a tough time thursday? >> reporter: he might. carney said he still believes brennan will be confirmed, but in a letter to president obama, 11 senators said that this could complicate those confirmation hearings, including ron widen, susan collins of maine saying that they want more answers about this. of course, brennan is really the only person in the administration who has spoken directly about the drone program making the point that the administration only targets someone if they believe they have good cause, if they believe that there won't be a lot of collateral damage. so this is something that he has talked about. carney pointed to the fact that a lot of this is still classified, so there are probably limits to what he can be asked during this confirmation hearing, but, martin, he's going to get some tough questions. >> and you will be there to report on it. nbc news white house correspondent kristin welker. thank you. >>. >> rep
